HAAUS Digital Products Terms

Version 1.1

These terms apply to digital products bought from HAAUS. They do not apply to our interior design, building or consultation services, which are covered by our Terms and Conditions. If the two ever say different things about a digital product, go by these terms.

In these terms, we, us and HAAUS mean HAAUS. Pty Ltd ACN 663 027 316, ABN 97 663 027 316. You means the person buying the product. A product means any guide, planner, calculator, template or other digital item we sell, including anything published under the name HAAUS Business Academy.

Buying from us

By buying a product you agree to these terms. You confirm that you are at least 18 years old, or that you have the permission of a parent or guardian, plus that the payment details you use are your own or that you are authorised to use them.

If you are buying on behalf of a business, you confirm you are authorised to accept these terms for that business.

What you are buying

Each product page describes what the product is, how many pages or files it contains, plus what it covers. Prices are shown in Australian dollars as a single total figure including GST where GST applies. Products are delivered as an immediate download, with a link also sent to the email address you give at checkout.

You are buying a licence to use the product. You are not buying ownership of it.

What you need in order to use it

Some products require particular accounts, apps, devices or software. Where that is the case, the product page says so. It is your responsibility to check that you have what is listed before you buy. Many of our products need nothing beyond a device that can open a PDF.

We cannot control third party platforms. Their features, labels, menu positions, availability, limits, plans plus pricing may change at any time after we publish a product. We are not responsible for those changes. Where possible our products name the relevant feature rather than relying on where it sits on screen.

Your licence

Buying a product gives you a personal, non-exclusive, non-transferable licence to use it in your own business, for as long as you hold a copy. The licence covers you, or the single business you bought it for.

You may:

  • print the product for your own use
  • complete any planner, worksheet or calculator inside it
  • apply what it teaches in your own content plus your own business
  • keep your copy indefinitely

You may not:

  • copy, share, resell, publish, sublicense or distribute the product, in whole or in part
  • share login or account details for any online material, or let another person use your access
  • upload it to any file sharing service, group, drive or membership site
  • reproduce our text, tables, planners, worked examples, screenshots or images in any product, course, template, presentation or material you offer to others, whether paid or free
  • use the product to deliver paid training to others, unless the product itself says you may
  • remove or alter any copyright, branding or attribution

Artificial intelligence. You may not use any part of a product, including its text, images, photographs, screenshots or design, to train, fine tune or ground any artificial intelligence or machine learning system, or to generate material that reproduces it.

Buying a product gives you no right to use the HAAUS name, logo or trade marks.

Our intellectual property

All content in our products, including written material, layouts, tables, planners, worked examples, photographs, screenshots, graphics plus design, is owned by HAAUS. Pty Ltd or used with permission. It is protected by the Copyright Act 1968 (Cth) plus equivalent laws elsewhere.

Nothing in these terms transfers any intellectual property to you.

Copyright protects the way we express something, not the underlying idea. You are free to learn a method from a product then apply it in your own work in your own words. What you may not do is reproduce our expression of it.

Educational purpose

Our products are educational. They are based on our own experience of running HAAUS.

They are not a substitute for professional financial, legal, accounting, tax, building or construction advice. They are not tailored to your circumstances. If you need advice for your specific situation, speak to a qualified professional.

You are responsible for how you apply what you learn, plus for complying with the laws, licensing requirements plus platform rules that apply to you.

Results

We do not guarantee any particular result, income, growth, reach, engagement, followers, sales or business outcome.

Results vary. They depend on your effort, consistency, the content you make, your audience, the platform, timing, your market plus many factors outside our control. Most people who buy educational products do not fully implement what they teach, so outcomes differ accordingly.

Any figures, case studies, screenshots or examples we publish describe what happened in a specific situation, usually our own. They are illustrative. They are not a promise, a projection or a typical result, so they should not be read as one.

Platform rules

Some of our products describe how to use third party platforms such as Instagram. You remain responsible for complying with those platforms' own terms, community guidelines plus advertising policies.

If you promote your business using anything you learn from us, you are responsible for making sure your claims are accurate plus substantiated, in line with the Australian Consumer Law plus any advertising rules that apply to you.

We are not affiliated with, endorsed by or sponsored by Meta Platforms, Instagram or any other platform we mention.

Payment

Payment is taken at checkout through our payment provider. We do not store your full card details.

Prices are in Australian dollars. If you pay in another currency, your bank or card issuer sets the exchange rate plus may charge a conversion fee. That is between you and them.

Prices quoted in a confirmed order are fixed. Later price changes are not applied retrospectively.

Delivery

Access is provided immediately after payment is confirmed, plus a link is emailed to the address you give at checkout. Download links do not expire, though we recommend you save a copy somewhere safe.

If your download does not arrive, check your junk folder first, then email admin@haaus.com.au plus we will send it to you directly.

Refunds plus your rights

Because our products are delivered immediately, we generally do not offer change of mind refunds once access has been provided.

This does not affect your rights under the Australian Consumer Law. Our products come with consumer guarantees that cannot be excluded. If a product is not of acceptable quality, does not match its description, or is not fit for a purpose we told you it was fit for, you are entitled to a remedy. Where the failure is major you choose whether you want a refund or a replacement. Where the failure is minor we may offer to correct the problem first. Where a refund applies we pay it to your original payment method.

Buyers outside Australia

We sell worldwide. Your local consumer protections are not removed because we are based in Australia, plus our Australian obligations do not disappear because you are not.

European Union plus United Kingdom. You normally have 14 days to cancel an online purchase without giving a reason. That right does not apply to digital content once you have expressly agreed to immediate delivery plus acknowledged that you lose the right to cancel. We ask you to confirm both before you buy, plus we keep a record of it. If you did not confirm them, plus you have not downloaded the product, contact us within 14 days and we will cancel your purchase and refund you.

If you have a problem

Email admin@haaus.com.au with your order number plus a description of the issue. We aim to respond within five business days. We would much rather fix a problem than have it become a dispute.

Please contact us before raising a chargeback with your bank. Nothing in these terms limits your right to raise a dispute with your bank or card issuer.

Liability

Nothing in these terms excludes, restricts or modifies any right, guarantee or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

Subject to that, plus to the maximum extent permitted by law, our total liability to you for any claim arising out of a product is limited to the amount you paid us for that product. We are not liable for indirect or consequential loss, loss of profit, loss of revenue, loss of opportunity or loss of data.

We do not warrant that our website or download links will be uninterrupted or error free. You are responsible for keeping your own copy of anything you download.

If you breach these terms

If you breach the licence or intellectual property terms above, in particular by copying, sharing, reselling or reproducing a product, you indemnify us against any claim, loss or cost we suffer as a direct result of that breach. This applies only to a breach of those terms. It does not make you responsible for anything else.

Nothing in this section applies to a mere failure to get the results you hoped for, or to anything arising from our own conduct.

Ending your licence

Your licence ends if you breach these terms, in particular by copying, sharing or reselling a product. If that happens we may withdraw access to any online material plus decline future sales. We may take action to protect our intellectual property.

Ending your licence does not affect your rights under the Australian Consumer Law.

Privacy

We collect your name, email address plus order details in order to deliver your purchase plus provide support. Payment details are handled by our payment provider, not by us. See our Privacy Policy for how we handle personal information.

Changes to these terms

We may update these terms. The version that applies to your purchase is the version published at the time you bought. We do not apply changes retrospectively. Each version is numbered at the top of this page.

General

Governing law. These terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales. If you are a consumer in another country, this does not deprive you of the protection of any mandatory law of the country where you live.

Whole agreement. These terms, together with our Refund Policy plus Privacy Policy, record everything agreed between us about a digital product.

Severance. If any provision is unenforceable it is severed plus the rest continues.

Assignment. You may not transfer your rights under these terms. We may assign ours as part of a sale or restructure of our business.

Electronic acceptance. Ticking the acceptance box at checkout, or completing a purchase, has the same effect as a signature.
